I, for and on behalf of myself and my children, heirs, executors, administrators, and representatives, agree to release, indemnify and defend the Wonderfund, its officers, employees, and representatives with respect to all claims, liabilities, losses, suits, or expenses (including costs and reasonable attorneys fees) made or brought by anyone, arising out of any injury, damage, death, or other loss in any way connected with my participation as a volunteer driver for the Wonderfund. This agreement includes any losses claimed to be caused, in whole or in part, by the negligence of the Wonderfund. I understand I agree here to waive all claims against the Wonderfund and agree that neither I nor anyone acting on my behalf, will make a claim or file a lawsuit of any kind against the Wonderfund, as a result of any injury, damage, death, or other loss suffered by me.

I state that I am an adult over the age of 21 with a valid driver’s license and that I have at least the minimum amount of liability insurance specified by the Commonwealth of Massachusetts. I will notify the Wonderfund in writing if there is a change in the status of my driver’s license or vehicle liability insurance. I understand that any cause of action arising out of my voluntary participation is my sole responsibility, and agree to solely pursue my vehicle liability insurance for any causes of action for personal injury, property damage, or death arising from my actions and not to sue the Wonderfund.

I agree that this and all aspects of my relationship to the Wonderfund are governed by Massachusetts law. Further, any mediation, suit, or other proceeding arising out of or relating to my participation in the Wonderfund activities, must be filed exclusively in the Commonwealth of Massachusetts, and Massachusetts law shall apply.

Any portion of this document deemed unlawful or unenforceable shall not affect the remaining portions of the Document, and those remaining provisions shall continue in full force and effect.

I have carefully read, understand, and voluntarily sign this Document and acknowledge that it shall be effective and binding upon myself, my family, heirs, executors, representatives, and estate.

As a volunteer for the Wonderfund, I understand that my safety and the safety of others are paramount. I understand that driving as a volunteer is a privilege, not a right, and therefore, I agree to:

• Provide evidence of my current status as a licensed driver in Massachusetts
• Provide evidence of my liability insurance on a yearly basis as requested
• Comply with all of the Wonderfund’s policies and procedures and any directions provided by my supervisor
• Comply with all laws and regulations concerning driving, including laws pertaining to the use of seat belts, child safety seats, cell phone use, and speed limits
• Promptly notify my supervisor of any physical conditions, vehicle defects, or road conditions that might affect my safety or the safety of those I am driving
• Notify my supervisor of any traffic citations I receive - even if given while driving on my personal time
• Watch driver training videos at the request of the Wonderfund
• And, if involved in an accident, I agree to complete an Accident Report provided by the Wonderfund and to cooperate with the police, my supervisor, my insurer, and the Wonderfund’s attorneys.
• Take reasonable care to ensure that all goods entrusted to me by the Wonderfund are not damaged, and that they are delivered in full to the agreed-upon Massachusetts Department of Children and Families (DCF) office. I understand that I may be held responsible for any expenses related to the damage, loss, or mishandling of said goods.

I pledge that if I drive my own vehicle, or a rented vehicle on behalf of the Wonderfund, I will maintain adequate personal auto insurance and a valid driver’s license. I also understand that as a volunteer driver, my personal auto insurance will be activated for any accidents or incidents that involve my vehicle, including those that occur while I am serving as a volunteer driver for the Wonderfund.
